Postanowienia wstępne

Platforma artystyczna prowadzona pod adresem internetowym https://casewise.pl/ przez MarketWise sp. z o.o. (dalej „Administrator”), umożliwia Artystom korzystanie z usług związanych z przesyłaniem prac artystycznych, obsługą płatności, realizacją wypłat wynagrodzeń oraz spełnianiem wymogów podatkowych.

Niniejszy regulamin skierowany jest do Artystów i określa zasady oraz tryb korzystania z platformy, w tym zawierania Umowy o świadczenie usług między Artystą a Administratorem. Usługi świadczone przez Administratora obejmują w szczególności:

• udostępnienie platformy do przesyłania i przechowywania prac artystycznych,
• obsługę finansową, w tym realizację wypłat wynagrodzeń,
• umożliwienie spełnienia obowiązków podatkowych wynikających z zawartej umowy.

Korzystanie z platformy jest odpłatne, a szczegóły dotyczące wynagrodzenia Artysty i prowizji Administratora określa Umowa („Contract”) zawarta pomiędzy stronami.

Administrator świadczy usługi zgodnie z zasadami określonymi w niniejszym regulaminie, a korzystanie z platformy jest równoznaczne z akceptacją jego postanowień.

Wymagania techniczne

Do korzystania z platformy artystycznej („Dashboard”), w tym zakładania konta, przesyłania prac artystycznych oraz zarządzania danymi, niezbędne są:

1. Urządzenie końcowe z dostępem do Internetu oraz przeglądarką internetową wspierającą aktualne standardy bezpieczeństwa (np. Google Chrome, Mozilla Firefox, Safari).
2. Aktywne konto poczty elektronicznej (e-mail), które będzie używane do logowania oraz komunikacji z platformą.
3. Włączona obsługa plików cookies i skryptów JavaScript, które są niezbędne do prawidłowego działania platformy.
4. Możliwość przesyłania plików w formatach akceptowanych przez platformę (np. PNG, JPG, PDF) oraz zachowanie minimalnych wymagań technicznych dla przesyłanych prac (zgodnie z wytycznymi w panelu użytkownika).

Platforma artystyczna może nie działać poprawnie na urządzeniach lub w środowiskach niezgodnych z powyższymi wymaganiami.

MarketWise sp. z o.o., w najszerszym dopuszczalnym przez prawo zakresie, nie ponosi odpowiedzialności za zakłócenia, w tym przerwy w funkcjonowaniu platformy, spowodowane siłą wyższą, niedozwolonym działaniem osób trzecich lub niekompatybilnością infrastruktury technicznej Użytkownika z wymaganiami platformy.

E-maile

Rejestrując się na platformie artystycznej („Dashboard”) oraz akceptując regulamin, wyrażasz zgodę na otrzymywanie wiadomości e-mail od Administratora (MarketWise sp. z o.o.), które mogą obejmować:

1. Przypomnienia o konieczności uzupełnienia brakujących informacji w Twoim profilu, w tym danych podatkowych, danych kontaktowych lub danych płatności.
2. Powiadomienia dotyczące wypłat (payoutów), w tym potwierdzenia realizacji płatności, ewentualnych błędów w danych lub prośby o ich korektę.
3. Ankiety dotyczące korzystania z platformy, opinii na temat jej funkcjonalności oraz jakości obsługi.
4. Powiadomienia o zleceniach, statusie Twoich prac artystycznych lub innych związanych z realizacją umowy.
5. Informacje o nowych funkcjonalnościach platformy, zmianach regulaminu lub ważnych aktualizacjach dotyczących Twojego konta.

Administrator zastrzega sobie prawo do wysyłania wyżej wymienionych wiadomości w celach administracyjnych, informacyjnych lub organizacyjnych. Wiadomości te są niezbędne do zapewnienia prawidłowego funkcjonowania platformy oraz realizacji umowy.

Postanowienia niniejszego regulaminu są uzupełnione przez szczegółową umowę („Contract”) w języku angielskim, która określa warunki współpracy z Artystami, w tym prawa i obowiązki stron, wynagrodzenie oraz zasady korzystania z prac artystycznych. Strony uznają język angielski jako obowiązujący dla niniejszej umowy. Niniejsza umowa podlega prawu polskiemu, a wszelkie spory będą rozstrzygane przez sądy właściwe w Polsce.

Założenie konta na platformie artystycznej jest równoznaczne z akceptacją niniejszego regulaminu oraz umowy w języku angielskim. Od momentu założenia konta Artysta wyraża zgodę na przestrzeganie postanowień regulaminu i umowy, które stają się prawnie wiążące.

Platforma rejestruje datę i godzinę założenia konta jako moment wejścia w życie regulaminu i umowy.

Responsibilities of the Artist:

3. The responsibility for ensuring the accuracy of the submitted information lies solely with the Artist. Any inaccuracies, omissions, or errors in the provided data do not affect the validity of this agreement or the Artist’s liability under it.

4. The Artist guarantees that the submitted information is true and correct to the best of their knowledge and accepts full responsibility for any consequences arising from false or inaccurate data.

5. The Service Provider (MarketWise sp. z o.o.) does not verify the accuracy or authenticity of the provided information beyond formal checks for completeness and technical compatibility. The Service Provider will not be held liable for any legal or financial consequences resulting from inaccuracies, including but not limited to intellectual property infringement or tax compliance issues.

6. Should any dispute, claim, or legal action arise due to inaccuracies in the Artist’s submitted data, the Artist agrees to fully indemnify and hold the Service Provider harmless from any damages, liabilities, costs, or expenses, including legal fees.

§1 Subject of the Agreement

1. The Artist commits to providing artistic works that meet the technical requirements

specified in Appendix No. 1 (without watermarks, dimensions of 2000x1000 pixels, the main

content within 1900x900 pixels with an additional 100 pixels on each dimension serving as a

non-critical safety margin).

2. The works should be described in a manner consistent with the theme of the work and

related to it.

§2 Declarations and Obligations of the Artist

1. The Artist declares that they are conducting business activities, are not a consumer, and

will fulfill tax obligations related to this agreement.

2. The artist declares that they are the owner of the works and possess full rights to them

3. The Artist agrees to the use and sale of their works on the websites owned by MarketWise

sp. z.o.o.

4. The Artist consents to the use of the provided works in the Service Provider's advertising

materials and to their public availability for sale by the Service Provider and its

subcontractors.

5. The Artist agrees to modify the works to fit the size of phone cases or phone.

6. The artist agrees to : abide by the rules and regulations of the CaseWise brand, take care to

know the current one and declares that he accepts its provisions.

7. The works should be submitted via email to office@oditwise.com/virtual disk or another

pre-agreed location.

§3 Remuneration and Payment Terms

1. The artist's fee is $1.5 gross for each order involving the artist's work..

2. The remuneration will be calculated based on sales records and settled monthly, with

payments made when the amount exceeds 50 USD.

3. The Artist is obligated to issue an invoice based on sales records by the 5th day of each

month with the sale date being the last day of the previous month; otherwise, the settlement

will be transferred to the next month.4. Payments for returned or claimed orders will be cancelled or deducted from the next

settlement.

5. MarketWise accounts for fees for the seller.

6. The Artist declares that they have all rights to the provided works and that the works are

free from defects, errors, and faults.

7. For the verified provision of services by the Artist related to the delivery of graphics, the

Service Provider commits to paying fees to the Artist.

§4 Advertising Restrictions

1. The Artist/User/Influencer agrees to:

a. Not make direct references from Google Ads to the MarketWise domain.

b. Not make direct references from other advertising sources (e.g., Facebook, text ads) to

the MarketWise domains, except for sources owned by the Artist/User/Influencer.

c. Not use the word CaseWise or similar sounding words in domain names and social

media accounts as a keyword in Google Ads and similar advertising systems.

d. Not use the CaseWise domain name as a keyword.

e. Not use the CaseWise name and logo in advertising materials, except those provided by

MarketWise.

f. Not use links related to sharing and earning on coupon/cashback websites.

§5 Additional Provisions

1. Any dispute arising from this agreement will be settled by Polish courts.

2. The Artist is obliged to maintain only one account on the site.

3. Upon termination of the agreement, all placed orders will be executed.

4. MarketWise has the right to cancel payments in case of infringement of intellectual

property rights by the Artist.

5. The Artist/User/Influencer commits to providing true and current data and representing

that they have full authority to enter into the agreement on behalf of the represented entity.

6. The Artist is solely responsible for the data provided in the payment process, such as the

PayPal email address. If the provided data is incorrect or invalid, then the Artist loses the

right to settlement. Furthermore, the Artist explicitly waives any claims against the Service

Provider related to such errors in payment data.

7. The Service Provider informs that it does not control, monitor, or verify Product Designs at

any stage of their presentation (before, during, or after posting) for compliance with law and

regulations, as well as for potential infringement of third-party rights. However, upon

receiving official notification about the illegal nature of any Product Designs or related

activities, the Service Provider will take immediate action to prevent access to these Product

Designs.

§6 Intellectual Property Rights Protection

1. The Artist commits to not posting content that infringes the rights of third parties.

2. In case of infringement of copyrights or other rights of third parties, the Artist bears full

responsibility.

3. The Service Provider reserves the right to demand evidence related to the source of traffic

on the Artist's page

§7 Final Provisions1. The agreement comes into effect on the date of creating an account

and is concluded for an indefinite period of time

2. Any changes not included in the terms and conditions of

CaseWise, shall be in writing under pain of nullity.

Postanowienia końcowe

1. Umowy zawierane poprzez platformę artystyczną są zawierane w języku angielskim lub polskim, w zależności od wybranego języka rejestracji.

2. Administrator zastrzega sobie prawo do dokonywania zmian Regulaminu z ważnych przyczyn, takich jak:

   • zmiany przepisów prawa,
   • zmiany funkcjonalności platformy,
   • dostosowanie warunków świadczenia usług do obowiązujących regulacji lub wymagań technicznych,
   • konieczność zmiany zasad rozliczeń finansowych, w tym wysokości wynagrodzeń dla Artystów, wynikająca z przyczyn ekonomicznych, operacyjnych lub rynkowych.

   O każdej zmianie Regulaminu, w tym dotyczącej wynagrodzeń, Administrator poinformuje Artystów z odpowiednim wyprzedzeniem, umożliwiającym zapoznanie się z nowymi warunkami przed ich wejściem w życie.

3. W sprawach nieuregulowanych w niniejszym Regulaminie mają zastosowanie powszechnie obowiązujące przepisy prawa polskiego, w szczególności:

   • Kodeksu cywilnego,
   • ustawy o świadczeniu usług drogą elektroniczną,
   • ustawy o prawach konsumenta,
   • ustawy o ochronie danych osobowych.

4. Akceptując Regulamin, Artysta wyraża zgodę na otrzymywanie faktur, rachunków i innych dokumentów księgowych drogą elektroniczną.

5. Założenie konta na platformie artystycznej jest równoznaczne z akceptacją niniejszego Regulaminu oraz umowy („Contract”) w języku angielskim, które stają się prawnie wiążące od chwili rejestracji.
